Abstract

Land is the place where every humans continue their life and keep moving forward, in the past, now and later. The problems about abandoned land nowadays was formed because of gradual accumulation of unsolved land abandonment in the past time. The existence of abandoned land was caused by some land-owner who could not make the land officially theirs or inappropriate land efficiency on the basic submission of land-rights capability. As-if can be predicted for the emerges of abandoned land, based on UUPA statement, one of the cause land rights disappearance is, if the owner “abandon” the land for a long time, and because of that the landowner should manage their own land based on the main usage of the land itself. there are four ways to making order about abandoned lands, they are, inventorying land-rights or authority on every land that indicated as abandoned land and reclaim its rights, identification and research attempt on abandon-indicated land, warnings to every owner of abandoned land and determining of abandoned land, based on the rules of national land-management institution headmaster number 4 year 2010 about abandoned land management. This research implementing juridical normative, using Indonesia ordinance as research base, and sustained with interview datagathered from the coordinator of Indonesian Farmer Union and BPN of Sukabumi Regency and furthered analyzed for the researcher can conclude a result. The main aim of this research is to know the role of BPN of Sukabumi Regency in implementing government rule No.10 year 2010 on PT. Surya Nusa Nacipta case with Indonesian Farmers Union (SPI) and also to know every efforts of national land-management institution (BPN) of Sukabumi regency on case of on PT. Surya Nusa Nacipta case with Indonesian Farmers Union (SPI). The result of the research is there is no active role attempted by BPN of Sukabumi regency in this case, and also direct rules that protecting every single work-on citizen, thus, no rules for certain punishment for every landrights owner that non-accidentally not using their lands based on its function and purpose.
