Abstract

Health workers in practice often cause polemics such as being negligent or making mistakes in carrying out their duties when caring for patients, in their responsibilities a health worker often avoids responsibility for what he has done, therefore what form of responsibility must the health worker bear. workers who commit malpractice and how is law enforcement in Indonesia related to medical malpractice. This study uses a qualitative approach method. Based on the research that the researchers conducted, it can be concluded that criminal law enforcement against malpractice crimes is still lacking in handling, because the regulations governing malpractice acts have not been specifically regulated and there is no liminative that provides boundaries regarding malpractice. action. Criminal liability begins with an error, whether intentional or due to negligence, in this case it becomes a reference for whether there is accountability that has been carried out by health workers, criminal liability for health workers is contained in Law Number 36 of 2009 concerning Health and Law Number 36 of 2014 concerning Health Workers
