Abstract

This research was conducted using normative juridical research methods and literature studies on the Arisan Online Phenomenon in Indonesia. Arisan Online is an arisan activity that is carried out online or through social media which is carried out by several parties using the cash circulation method. Fraud cases with the Arisan Online mode are mostly carried out on various social media such as WhatsApp, Facebook and Instagram. But apart from the positive impacts, there are also negative impacts through this development. This study explains how the legal protection for victims who experience losses due to online-based arisan is viewed from article 1243 of the Civil Code and how the law is enforced against owners of unlicensed online arisan. In April 2023, the case of the sultan's arisan in Sukabumi began when the owner spread information about arisan and investments through Instagram social media. Arisan owners Promise profits ranging from 5 to 10 percent. However, after the agreed maturity date, neither capital nor profits were ever returned. The form of legal protection for online arisan participants is to pay compensation as stipulated in Article 1243 of the Civil Code in addition to compensation. Forms of law enforcement for online arisan owners can be charged with Article 372 in conjunction with Article 378 of the Criminal Code and/or Law of the Republic of Indonesia Number 8 of 2010.
