Abstract

Narcotics are addictive substances that are useful for relieving aches and pains. A victim of narcotics abuser is someone who accidentally uses narcotics because he is persuaded, tricked, cheated, forced, and/or threatened to use narcotics. This study uses a normative juridical approach. The data used in this study are primary data and secondary data, including data taken directly at the Sukabumi City Police Resort, as well as direct interviews with related agencies. Meanwhile, data processing is used by means of data selection, data classification and data compilation. The processed data were analyzed qualitatively. The results of this study indicate the conclusion that Decision Number 8/ Pid . Sus / 2019 / PN SKB there is a rehabilitation order due to the recommendation letter for the rehabilitation of the National Narcotics Agency and Decision Number 92 / Pid . Sus/2019/PN there is no recommendation letter for the rehabilitation of the National Narcotics Agency . The effectiveness of imprisonment and rehabilitation punishment in reducing the number of narcotics abusers , is more inclined to rehabilitation because rehabilitation is an effort to recover for victims of narcotics abusers , while imprisonment is more likely not to restore victims of abusers but can potentially transfer the status of users to dealers. Rehabilitation is very necessary for victims of narcotics abuse , narcotics dependence and narcotics addicts because in addition to recovery, legal rehabilitation is ordered by Article 103 of Law 35 of 2009, Supreme Court Circular No. 4 of 2010 and Joint Regulations regarding rehabilitation for victims of narcotics abusers.
