Abstract

In Indonesia, drug abuse or dependence is now becoming more prevalent. We can observe this from the news in both print and electronic media, which almost daily reports about the arrest of drug abuse perpetrators by security forces. The main problems in this research are 1) What are the factors that cause children to commit narcotics crimes in the verdict caseNumber: 01 / Pid-Sus-Anak / 2015 / PN.Cbd. 2) What is the judge's consideration in imposing criminal sanctions against children who commit narcotics crime in the case of judgmentNumber: 01 / Pid-Sus-Anak / 2015 / PN.Cbd. The research method used by the author is juridical normative and juridical empirical, namely research on legislation and conducting field research and secondary data tracing as a basis for researching legal incidents in cases of narcotics abuse by children under the verdict Number: 01 /Pid-Sus-Anak/2015/PN.Cbd. The results of the study found that 1) the factors that caused the child to abuse the narcotics crime in the decision case Number: 01 / Pid-Sus-Anak / 2015 / PN. Cbd, namely, in terms of age factors, family factors, child sex factors. Because a young age tends to have a sense of curiosity, plus a family who doesn't care enough so that children prefer to go out with their friends and enter the wrong relationship. 2) The judge's consideration in imposing sanctions on children who misuse narcotics in the case of dropout Number: 01 / Pid-Sus-Anak / 2015 / PN.Cbd is, in terms of the defendant's good behavior, has never been convicted, and is still classified as a child. The implication that can be applied in this research is that the family can become a basic foundation in providing knowledge and guidance and then become the foremost foundation in prevention efforts so that the child does not commit a crime.
